This End User License Agreement ("EULA") governs your use of the Aglyn software, applications, site builder ("Besigner"), plugins, SDKs, client-side components, templates, sample code, and documentation made available by Aglyn LLC, a Texas limited liability company ("Aglyn," "we," "us," or "our") (collectively, the "Software"). This EULA supplements and is incorporated into the Terms of Service. If there is a conflict, the Terms of Service control unless this EULA expressly states otherwise. By accessing or using the Software, you agree to this EULA.
The Software is pre-release, beta, and provided "AS IS" and "AS AVAILABLE" for use and evaluation. It may be incomplete, contain defects, change, or be discontinued at any time, with or without notice. Do not use the Software for high-risk, mission-critical, or business-critical purposes, and maintain your own backups. All disclaimers and limitations in the Terms of Service (including Sections 14 and 15) apply to the Software.
Subject to your compliance with this EULA and the Terms of Service, and payment of applicable fees, Aglyn grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license, during your subscription term, to access and use the Software solely to build, operate, and manage your own Hosts and to use the Services as intended, and to use provided templates, components, and sample code within your Hosts. No rights are granted except as expressly stated.
You will not, and will not permit anyone to:
The Software is licensed, not sold. Aglyn and its licensors retain all right, title, and interest in and to the Software and all intellectual property therein, including all trademarks (such as "Aglyn" and "Besigner"), designs, templates, and documentation. All rights not expressly granted are reserved.
The Software may include third-party or open-source components licensed under their own terms, which apply to those components and, in case of conflict for those components, control. Third-Party Services accessed through the Software are governed by their providers' terms. Aglyn also publishes some of its own source code under the Apache License, Version 2.0; where you exercise rights under that license, its terms govern that code. This Agreement governs the Software as Aglyn distributes and operates it, including the hosted Services, and Aglyn's trademarks, which the Apache License does not grant.
Templates, sample code, and AI-assisted output are provided to help you build Hosts. They are provided "AS IS," without warranty, and you are responsible for reviewing, testing, and validating them (including for accuracy, security, licensing, and legal compliance) before use. You are responsible for ensuring you have all rights necessary for any content you incorporate into your Hosts.
We may provide updates, patches, or new versions, and may modify, add, remove, or discontinue Software features at any time, with or without notice. Updates are subject to this EULA unless accompanied by separate terms. We are not obligated to provide any update, maintenance, or support.
Any feedback you provide about the Software is licensed to us as described in the Terms of Service (Feedback section), on a perpetual, irrevocable, royalty-free basis.
This EULA is effective until terminated. It terminates automatically if you breach it or upon termination of your subscription or the Terms of Service. Upon termination, your license ends and you must cease using the Software and destroy any locally stored copies. Sections that by their nature should survive (including 3, 4, 6, 8, 10, 11, and 12) survive termination.
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. THE DISCLAIMERS (Section 14) AND LIMITATION OF LIABILITY (Section 15) OF THE TERMS OF SERVICE ARE INCORPORATED BY REFERENCE AND APPLY TO THE SOFTWARE AND TO THIS EULA IN FULL.
You may not use or export the Software in violation of applicable export-control or sanctions laws, and you represent you are not a restricted party or located in an embargoed region.
This EULA is governed by the laws of the State of Texas, and disputes are resolved under the governing-law, arbitration, and general provisions of the Terms of Service (Sections 18 and 19). If any provision is unenforceable, the remainder remains in effect.
