This Acceptable Use Policy ("AUP") governs your use of the Aglyn platform and Services and is incorporated into the Terms of Service. It applies to you, your Authorized Users, your Hosts, and (as your responsibility) your End Users. We may update this AUP at any time. Capitalized terms have the meanings given in the Terms of Service.
You are responsible for all activity on your Account, Organization, and Hosts, and for ensuring your End Users comply with this AUP.
1. Prohibited Content
You may not use the Services to create, host, store, publish, transmit, or distribute content that:
- is unlawful, defamatory, fraudulent, deceptive, or misleading;
- infringes or misappropriates any intellectual property, privacy, publicity, or other right (see the Copyright and DMCA Policy);
- is obscene, or that constitutes child sexual abuse material (CSAM) or sexualizes minors — strictly prohibited and reported to authorities as required by law;
- promotes or incites violence, terrorism, self-harm, or illegal activity;
- harasses, threatens, defames, or promotes hatred or discrimination against individuals or groups;
- contains malware, ransomware, spyware, or other harmful code;
- infringes export-control or sanctions laws, or facilitates illegal weapons, drugs, or human trafficking;
- constitutes unlawful gambling, pyramid schemes, or other prohibited financial schemes; or
- violates any applicable law or regulation.
2. Prohibited Conduct
You may not, and may not permit others to:
- gain or attempt unauthorized access to any system, account, data, or network;
- probe, scan, or test the vulnerability of the Services, or breach or circumvent security, authentication, rate limits, quotas, or usage measures, except through an authorized security-disclosure process;
- interfere with or disrupt the integrity or performance of the Services (including denial-of-service attacks, flooding, or overloading);
- use the Services to distribute spam or unsolicited bulk or commercial messages, or to violate anti-spam laws (e.g., CAN-SPAM, CASL, GDPR/ePrivacy);
- send email or messages without a lawful basis or required consent, or with false or misleading headers or sender information;
- scrape, crawl, or harvest data or content except as expressly permitted, or use bots to abuse the Services;
- misrepresent your identity or affiliation, or impersonate any person or entity;
- resell, sublicense, or provide the Services to third parties except as expressly permitted;
- use the Services to build a competing product or to benchmark without our consent;
- circumvent or manipulate fees, billing, metering, or usage limits; or
- engage in cryptocurrency mining, or other activity that places an unreasonable or disproportionate load on our infrastructure.
3. Commerce, Payments & Regulated Goods
If you use commerce, POS, subscription, paywall, digital-goods, gift-card, or marketplace features:
- you must comply with the terms of the payment processor (e.g., Stripe) and its prohibited/restricted-business rules;
- you must not sell goods or services that are illegal, restricted, counterfeit, stolen, or that violate the payment processor's rules;
- you are solely responsible for product legality, licensing, age restrictions, disclosures, taxes, fulfillment, refunds, and consumer-protection compliance; and
- you must not use the Services to process payments unrelated to your own bona fide business, to launder money, or to facilitate fraud or chargebacks.
4. Data, Privacy & End Users
- You must provide your own legally compliant privacy notice to your End Users and obtain any required consents (including for cookies, marketing, and data collection through forms, CRM, and analytics).
- You must not use the Services to unlawfully collect, use, or disclose personal information, or to process sensitive data without a lawful basis and appropriate safeguards.
- You are responsible for compliance with applicable data-protection laws (e.g., GDPR, UK GDPR, CCPA/CPRA) with respect to your End Users. See the Data Processing Addendum.
5. AI Features
You must not use AI-assisted features to generate prohibited content, to infringe rights, to deceive, or in violation of the AI provider's use policies. You are responsible for reviewing AI output before use.
6. Fair Use, Quotas & Rate Limits
The Services enforce plan quotas and rate limits (e.g., requests, storage, bandwidth, email sends, API usage). You must not circumvent them. We may throttle, suspend, or charge overage fees for usage exceeding your plan, and we may change quotas and limits at any time.
7. Enforcement
We may investigate suspected violations and may, in our sole discretion and without liability, remove or disable content, suspend or throttle features, suspend or terminate Accounts, Organizations, or Hosts, and report activity to law enforcement — at any time, with or without notice. We may also cooperate with legal authorities and Third-Party Services. We are not obligated to monitor content but may do so.
